Customer Trading Terms

9. Definitions

9.1 “The Purchaser”: The person or company ordering and receiving goods or services from The Company.
9.2 “Product/Goods”: Any machinery, consumables, or services offered by Eco Removal Systems Ltd.

10. Payment Terms

10.1 Credit Accounts: Payment is due 30 days from the date of invoice, unless otherwise agreed in writing.

10.2 Methods: BACS is preferred. Credit/Debit cards are accepted at our discretion.
10.3 Late Payment: We reserve the right to charge statutory interest (8% plus the Bank of England base rate) on late business-to-business payments.

11. Orders and Delivery

11.1 Shipping: All orders are supplied Ex Works (EXW).
11.2 Cancellations: ERS reserves the right to charge a 20% cancellation fee of the total invoice value if an order is cancelled after confirmation.
11.3 Returns: We do not offer refunds or exchanges. Faulty goods will be repaired or replaced at our discretion, subject to warranty terms.

12. Product Responsibility

12.1 Surface Damage: ERS accepts no responsibility for damage to any surface caused by the direct or indirect use of Ecogum equipment or consumables.
12.2 Operator Compliance: The Purchaser must ensure the operator manual is read and followed. ERS accepts no liability for misuse.

13. Service and Gum Removal

13.1 Acceptance of Service: By continuing to allow our service team to perform gum removal or maintenance for you, you are indicating your full acceptance of these Terms and Conditions.
13.2 Liability Limitation: Where our service team performs chewing gum removal on your behalf, Eco Removal Systems shall not be held liable for any damages, stains, ghosting, or marks left on the treated surface as a result of the removal process.
13.3 Variables and Pre-existing Conditions: The Purchaser acknowledges that the final result is influenced by the type of surface, the age of the surface, the duration the gum has been present, and any previous methods of chewing gum removal attempted by other parties. The removal process is undertaken entirely at the Purchaser's risk.

14. Warranty, Repairs, and Training

14.1 Warranty Coverage: All machines include a 12-month warranty covering defects in material or workmanship, provided only ERS consumables and fair usage guidelines are followed. For more information on warranties surrounding a specific product, please refer to your machine manual.

14.2 Warranty Exclusions: ERS reserves the right to revoke or void the warranty in the following circumstances:
-The use of non-Eco Removal Systems consumables.
-Malfunctions or conditions not resulting from defects in material or workmanship.
-General damage or excessive wear and tear.
-Failure to freewheel the Ecogum Truck when being manually pushed; this will specifically invalidate the warranty on the gearbox and motor.

14.3 Non-Warranty Repairs: If a product is assessed and determined not to be covered under warranty, the Purchaser is liable for all transport, labour, and parts costs associated with the repair.
14.4 Assessment Fees: In the event a product is assessed and found to be fully operational with no repair needed, the Purchaser will be liable for all transport costs and a labour charge for the assessment.
14.5 Training: On-site user training is available at a standard fee of £399, unless otherwise agreed in writing by Eco Removal Systems. Any additional training requests will incur extra fees.
